Privacy Policy

This policy explains what information Foxy Themes handles, why we use it, who processes it for us, and the choices available to you.

1. Scope and controller

Foxy Themes S.A.S. (“Foxy Themes,” “we,” “us,” or “our”) is the controller of personal information handled through foxythemes.net, including customer accounts, purchases, downloads, and contact requests. This policy does not govern third-party websites linked from our service.

2. Information we collect

We collect information you provide, information generated when you use the service, and limited information received from service providers:

  • Account information: name, email address, login credentials, verification status, and account creation or update dates.
  • Purchase information: transaction email, product purchased, amount, currency, payment status, transaction reference, and the access rights associated with your purchase.
  • Contact information: name, email, subject, message, and submission time when you contact support.
  • Usage and security information: basic device, browser, network, request, and fraud-prevention information needed to operate and protect the service.
  • Product interactions: the products associated with your purchases and downloads. We do not currently use behavioral advertising or website analytics tools.

3. How we use information

  • create and secure accounts and maintain signed-in sessions;
  • process purchases, record orders and entitlements, and provide secure downloads;
  • send transactional purchase confirmations and respond to support requests;
  • detect bots, fraud, abuse, and security incidents;
  • operate, troubleshoot, and improve reliability of the website;
  • maintain tax, accounting, legal, and transaction records; and
  • comply with law and enforce our terms and licenses.

5. Payment information

Payments are handled by a third-party payment processor. Foxy Themes does not receive or store your complete payment-card number or card security code. We receive limited transaction information needed to verify payment, maintain purchase records, provide access to the purchased product, prevent fraud, and assist with payment-related support. The payment processor handles payment information under its own privacy policy.

6. How information is shared

We do not sell or rent personal information and do not share it for cross-context behavioral advertising. We disclose only what is reasonably necessary to trusted service providers acting for us, such as providers that:

  • operate and deliver the website and purchased files;
  • process payments and help prevent fraudulent transactions;
  • deliver transactional purchase and contact emails;
  • store and manage account, purchase, support, and website information; or
  • protect the website and its users from misuse, automated abuse, and security threats.

These providers may use information only to perform services for us, comply with law, or protect their services. We may also disclose information when required by law, to protect rights and security, to investigate fraud, or as part of a merger, financing, acquisition, reorganization, or sale of business assets, subject to appropriate safeguards.

7. Cookies and similar technologies

The website uses cookies and similar browser storage that are necessary for account authentication, session security, and core functionality. These cookies allow you to remain signed in and help protect restricted account and download pages.

We do not currently use advertising cookies or third-party behavioral analytics. If that changes, we will update this policy and provide consent controls where required. You can block cookies in your browser, but account and protected-download features may stop working.

8. Data retention

We keep personal information only as long as reasonably necessary for the purposes described here. Retention depends on the type of record, your relationship with us, security needs, and legal obligations:

  • Account and active session information is kept while the account is active and for a reasonable period needed to process deletion, prevent abuse, or resolve disputes.
  • Order and entitlement records may be retained for the duration of the license and for applicable tax, accounting, fraud-prevention, and legal limitation periods.
  • Contact messages are retained only as long as needed to answer the request, maintain an appropriate support history, or establish and defend legal claims.
  • Expired verification and session records may be removed as part of routine maintenance.

We may retain de-identified information that can no longer reasonably identify you.

9. International processing

Our service providers may process information in Colombia, Canada, the United States, the European Economic Area, and other countries where they operate. Privacy laws in those places may differ from those in your jurisdiction. Where required, we rely on contractual and other legally recognized safeguards for international transfers.

10. Your privacy rights

Depending on where you live, you may have rights to request access to personal information, correction, deletion, restriction or objection to processing, data portability, withdrawal of consent, and information about disclosures. You may also have the right to complain to a privacy or data-protection authority.

Send requests to support@foxythemes.net. We may need to verify your identity before acting. Some information may be retained where required for transactions, security, legal obligations, or legal claims. We will not discriminate against you for exercising applicable privacy rights.

11. Security

We use reasonable administrative, organizational, and security safeguards intended to protect personal information and restrict access to accounts, transactions, and purchased files. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.

12. Children

The service is not directed to children under 16, and we do not knowingly collect their personal information. If you believe a child has provided information, contact us so we can investigate and delete it where appropriate.

13. Changes to this policy

We may update this policy when our practices, providers, or legal obligations change. We will post the revised policy with a new updated date and provide additional notice when required by law. Material changes apply prospectively.
